There is no demonstrated impact in Pennsylvania that including trans students in athletic participation in line with their gender identity creates a disadvantage for cisgender athletes, and science has shown that excluding students from athletic opportunities can cause negative mental health outcomes.

The bill would require K-12 and college sports teams be designated based on sex assigned at birth and creates a cause of action for lawsuits. The Pennsylvania Interscholastic Athletic Association and NCAA already have processes and policies in place. Similar legislation in other states has resulted in costly litigation to school districts.
